1. Who we are

Facility Pass ("we," "us," "our") provides community access to athletic facilities located at Chabot College, 25555 Hesperian Blvd, Hayward, CA 94545. Questions about these terms can be sent to support@facility-pass.com.

2. Bookings & passes

We offer two ways to use the facilities: hourly passes (pay as you go, including day passes and member-guest bookings) and monthly memberships. All access must be booked through our booking system and is subject to availability, capacity, and supervised public hours, which run around the facilities' internal and campus schedules and may change.

When you book an hourly pass, you may include additional people ("your party"). The person making the booking is responsible for their entire party and agrees to these terms on behalf of every attendee. Each attendee's details must be provided at the time of booking. Hourly passes are valid only for the date, time, and facility booked, and are non-transferable.

Member codes are personal and non-transferable — for the named member's use only, and may not be shared or lent. We may require photo identification at check-in for any booking or membership, and may refuse or revoke access for misuse.

3. Pricing, billing & renewal

Hourly passes are charged at the rate shown at checkout, as a one-time payment per booking. Memberships are billed monthly in advance at the rate shown when you subscribe, charged automatically to your payment method on file, and renew automatically each month until you cancel. We'll always email you a receipt.

Payment processing is handled by Stripe; by paying you also agree to Stripe's terms as the payment processor. We may change pricing with advance notice; any change to membership pricing takes effect on your next billing period after notice is given.

4. Cancellation & refunds

Hourly passes: Plans change — we get it. Cancel up to 24 hours before your booking for a full refund. Cancellations within 24 hours of the start time are non-refundable, since staffing and lifeguard coverage are scheduled in advance based on bookings. No-shows are treated as same-day cancellations. To cancel, email us.

Memberships: You may cancel at any time — no contracts, no minimum term. To cancel, contact us at support@facility-pass.com (or use the self-service option where available). When you cancel, your membership stays active through the end of the billing period you've already paid for, then stops renewing. Monthly charges already billed are non-refundable, except where required by law, and we do not pro-rate partial months.

5. Assumption of risk

You understand that use of athletic facilities and equipment — including pools, courts, fitness equipment, and related areas — involves inherent risks, including the risk of physical injury, illness, or, in rare cases, death. You voluntarily assume all such risks, whether known or unknown, arising from your use of the facilities and participation in any activity. If you book for a party, you confirm that every attendee assumes these risks.

You confirm that you (and each member of your party) are physically able to participate in the chosen activities and have no medical condition that would make such use unsafe. We strongly recommend consulting a physician before beginning any new physical activity.

6. Release of liability

To the fullest extent permitted by law, you agree to release, waive, and hold harmless Facility Pass, its operators, and the facility and property owners (including Chabot College and its district) from any and all claims, liabilities, or damages arising out of or related to use of the facilities by you or your party, except to the extent caused by gross negligence or willful misconduct. All facilities and equipment are used at your own risk.

7. Rules & conduct

These are active campus facilities. You and your party agree to follow all posted safety guidance, staff instructions, and school and campus rules at all times. All facilities and grounds are smoke- and vape-free. We may suspend or terminate a booking or membership, without refund, for conduct that is unsafe, abusive, or in violation of these rules.

8. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email or posted on this page, and your continued use after changes take effect constitutes acceptance of the updated terms.

9. Governing law

These terms are governed by the laws of the State of California. Any dispute relating to these terms, a booking, or a membership will be handled in the courts located in Alameda County, California.
